General Information This End User License Agreement (EULA) is a legal contract between you (“Licensee”) and Mission flats type (“Licensor”). When you purchase a font, you are purchasing the right to use that font under a particular set of conditions. It is important that you read and understand this Agreement because it defines your rights, the acceptable uses of the fonts, and the rights Licensor reserves. Once you download and/or install and/or use the Fonts by Licensor, you are confirming you understand and agree to the terms of this Agreement, and that you have the authority to bind the person or entity specified on your sales receipt to the terms of this Agreement.

  1. Licence

Desktop Subject to the terms and conditions hereof, Licensor hereby grants to Licensee a revocable, limited, non-exclusive, non-transferable , non-assignable, non-sublicensable right and license to install and use the Font Software solely by Licensee . Licensee can install and use the Font on the number of workstations specified on your sales receipt. Any agencies, studios, sub-contractors, affiliates, or vendors of the Licensee , or organizations owned by the Licensee, must acquire their own separate licenses.

  1. Permitted Uses & Restrictions

a. Authorized Use Permitted use of the Font Software for desktop use includes print publications, advertising, images for print and web (static/rasterized images), packaging, marketing, film and video, and any other medium in which the font software is not embedded within the medium. If furnishing the manufacturer/printer (Vendor) with the Font is required in order to reproduce a document, You may supply a copy of the font. Afterwards, you and Vendor must take steps to ensure copies have been destroyed.

b. Embedding of Fonts Embedding of Fonts in digital/PDF documents is allowed as long as 1) the Font Software is subset, 2) the document text can be viewed and printed but not edited, and 3) reasonable measures are taken to ensure recipients of documents cannot extract or use the embedded Fonts.

c. Web License, App License, Products Use of the Font, as noted below, is prohibited without first obtaining a separate license from Licensor: (a) alphabet related products (Custom License); (b) embedding in websites and apps (Web License), or embedding in software and devices (App License).

d. Modifications You may create outline artworks based upon the Fonts for your personal or business use. You may not: (a) decompile, reverse engineer, or disassemble the Font; (b) make any modification, adaptation, improvement, enhancement, translation or derivative work from the Font.

e. Back-up Copies. You may make a reasonable number of copies of the Font Software for back-up purposes only, provided that you retains exclusive custody and control over such copies. Copies must contain the same documentation, copyright, trademark, and other proprietary notices that appear on, in or with the Fonts Software.

3.Copyright / Ownership Licensor retains full title and ownership of these Typefaces both as artwork and software, including all subsequent copies of the artwork or software regardless of the format in which they are expressed or the media on which they are recorded. Any updates, revisions, enhancements or additions to the Typefaces supplied by Licensor under this Agreement shall become part of, and subject to, this Agreement.. The names of these typefaces are trademarks of Licensor, and as such may only be used in keeping with accepted trademark practice, including identification of the trademark owner’s name and only in conjunction with output produced using this font software. The parties agree that the Typefaces are the sole and exclusive property of Licensor, including all applicable rights to patents, copyrights, trademarks and trade secrets inherent therein and appurtenant thereto, and Licensee agree not to challenge Licensor’s rights thereto, or infringe the rights thereof. Licensee acknowledge that Licensee are not purchasing title to the Typefaces, but are rather being granted a license to use the Typefaces for the purposes set forth above. Except as provided herein, this Agreement does not grant Licensee any intellectual property rights in the Typefaces.

  1. Disclaimer of Warranties The font software is provided to licensee “as is” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, licensor expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the font software, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, licensor provides no warranty or undertaking, and makes no representation of any kind that the font software will meet licensee’s requirements, achieve any intended results, be compatible, or work with any other software, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.

  2. Limitation of Liability To the fullest extent permitted by applicable law, in no event will licensor have any liability arising from or related to licensee’s use of or inability to use the font software for (I) personal injury, property damage, lost profits, cost of substitute goods or services, loss of data, loss of goodwill, business interruption, computer failure or malfunction, or any other consequential, incidental, indirect, exemplary, special, or punitive damages or (ii) direct damages in amounts that in the aggregate exceed one hundred U.S. Dollars ($100.00). The foregoing limitations will apply whether such damages arise out of breach of contract, tort (including negligence), or otherwise and regardless of whether such damages were foreseeable or licensor was advised of the possibility of such damages.

  3. No Other Agreements This Agreement represents the complete and exclusive statement of the agreement between licensee and Licensor and it supersedes any proposal or prior agreement, oral or written, and any other communications relating to the subject matter of this Agreement. No variation of the terms of this Agreement or any different terms will be enforceable against Licensor in the absence of an express written amendment or consent, including a written express waiver of the affected terms of this Agreement. If any provision of this Agreement is declared by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions of this Agreement shall continue in full force and effect, and the invalid provision shall be replaced by Licensor with a provision that effects the intent of the invalid provision.

  4. Updates Licensor may from time to time in its sole discretion develop and provide updates to the Font Software, which may include upgrades, bug fixes, patches, other error corrections, and/or new features (collectively, “Updates”). Updates may also modify or delete in their entirety certain features and functionality. Licensor has no obligation to provide any Updates or to continue to provide or enable any particular features or functionality. licensee shall promptly download and install all Updates. All Updates will be deemed part of the Font Software and be subject to all terms and conditions of the Agreement.

8.Termination This license agreement will terminate automatically without notice from Licensor if licensee breach any of its provisions. With termination, licensee must immediately stop using the typefaces and the software and delete all copies of the Typefaces and the software from all medias. All rights to the typefaces, including their names and the software are owned by Licensor are protected by the copyright laws of Japan and other international provisions. If any part of this contract is found void and enforceable, it will not affect the validity of the balance of the contract, which shall remain valid and enforceable according to its terms. Once downloaded, fonts may not be returned or refunded.
